1. Agreement and Definitions
These Terms form an agreement between you and Pursuing.com, doing business through Pursuing.com. In these Terms, “Pursuing,” “Pursuing.com,” “we,” “us,” and “our” refer to that operator and its authorized affiliates, contractors, and service providers where the context requires.
“Platform” means Pursuing.com and its websites, forms, case-check tools, directories, dashboards, application programming interfaces, communications, software, automated tools, and related services.
“Participating Provider” means an attorney, law firm, legal intake provider, co-counsel network, litigation-support provider, or other authorized professional or organization that may receive or review information through the Platform.
Additional terms, disclosures, consents, order forms, insertion orders, subscription agreements, publisher agreements, or other written agreements may apply to particular services. If they conflict with these Terms, the more specific signed or electronically accepted agreement controls for that service.
2. Pursuing.com Is Not a Law Firm
Pursuing.com operates an advertising, technology, educational, intake, directory, and connection platform. Pursuing.com is not a law firm, does not practice law, and does not provide legal advice, legal representation, legal opinions, or legal strategy.
Information available through the Platform is general information only. It is not a substitute for advice from an attorney licensed in the appropriate jurisdiction who has reviewed the specific facts of your matter.
Pursuing.com is not a court, government agency, bar association, medical provider, insurer, claims administrator, settlement administrator, or emergency service.
3. No Attorney-Client Relationship
Visiting the Platform, completing a questionnaire, submitting a case, receiving a score or summary, communicating with Pursuing.com, or having information delivered to a Participating Provider does not create an attorney-client relationship.
An attorney-client relationship may be formed only when an attorney or law firm independently agrees to represent you and you complete any required engagement or representation agreement directly with that attorney or firm.
Pursuing.com is not a party to an attorney-client engagement agreement between you and a lawyer or law firm. Pursuing.com does not supervise legal services, control legal judgment, establish legal fees, or guarantee any professional’s conduct.
Communications with Pursuing.com are not automatically protected by attorney-client privilege, attorney work-product protection, or a lawyer’s professional duty of confidentiality.
4. Eligibility and Authority
You must be at least 18 years old and legally capable of agreeing to these Terms to create an account or submit information for yourself.
The Platform is not directed to children under 13. A parent, legal guardian, executor, administrator, agent under a valid power of attorney, or other authorized representative may submit information for another person only when legally authorized to do so.
When submitting information concerning another person, you represent that you have authority to provide the information, receive related communications, and request assistance concerning the matter.
You agree to provide truthful, current, and complete information and to correct material inaccuracies when discovered.
5. Case Submissions and Intake
When you submit information about a potential legal matter, you authorize Pursuing.com to receive, store, organize, review, enrich, classify, summarize, transmit, and otherwise process that information to operate the Platform and seek potential connections.
A submission may include names, contact information, dates, locations, descriptions of events, injuries, diagnoses, product use, employment information, photographs, videos, recordings, documents, correspondence, and other information relevant to a potential matter.
You represent that you have the right to submit all information and materials you provide and that your submission does not violate another person’s privacy, confidentiality, contractual, intellectual property, or other rights.
Do not submit original or irreplaceable evidence. Retain your own copies of all records. Pursuing.com does not guarantee permanent storage, successful transmission, or preservation of submitted materials.
6. Sensitive Information
Legal inquiries may involve sensitive information, including health, injury, disability, financial, employment, family, biometric, location, or other personal information.
Provide only information reasonably necessary for the inquiry. Unless specifically requested through a secure process, do not submit full Social Security numbers, financial account credentials, passwords, complete payment-card information, or other identifiers that are not needed for an initial review.
Pursuing.com is generally not a healthcare provider, health plan, healthcare clearinghouse, or law firm. Information submitted to Pursuing.com should not be assumed to receive the same protections that may apply when information is provided directly to a healthcare provider or retained attorney.
Our collection, use, disclosure, retention, and protection of personal information are further described in our Privacy Policy.
7. Automated and Artificial Intelligence Tools
The Platform may use automated systems, artificial intelligence, machine learning, rules, scoring models, or third-party technology to organize, summarize, classify, translate, prioritize, enrich, route, or display information.
Automated output may be incomplete, inaccurate, delayed, or inappropriate for a particular situation. It is not legal advice, a legal opinion, a diagnosis, a valuation, or a prediction of whether a claim will succeed.
No automated score, summary, recommendation, category, eligibility indicator, estimated value, or routing decision determines your legal rights or obligates any attorney or firm to review or accept your matter.
Participating Providers make their own independent decisions. You should verify important information and should not rely on automated output to calculate deadlines, choose legal strategy, settle a claim, sign a release, or decide whether to seek professional advice.
We may use third-party technology providers to process information on our behalf. Our Privacy Policy describes the applicable data-handling practices. We will not represent that submitted case information is used to train a general-purpose artificial intelligence model unless that use is disclosed and legally permitted.
8. Attorney Connections and Lead Routing
Pursuing.com may share a submission with one or more Participating Providers that may be interested in reviewing the matter. We may also route information through authorized intake, co-counsel, referral, or technology partners that assist in locating potential counsel.
Routing may be based on factors including practice area, jurisdiction, geography, licensing, campaign requirements, provider capacity, availability, conflict checks, intake criteria, service levels, contractual relationships, and compensation.
Participating Providers may pay Pursuing.com for advertising, subscriptions, technology, intake, lead delivery, marketing, directory placement, platform access, or other services. These financial relationships may affect visibility, routing, or which providers receive an inquiry.
Pursuing.com does not represent that a connection is neutral, random, exhaustive, or based solely on attorney quality. Unless expressly stated otherwise, Pursuing.com does not recommend, rank, certify, endorse, or identify the “best” attorney or law firm for you.
Pursuing.com is not representing that it is a nonprofit or bar-approved lawyer-referral service. A connection is an opportunity for the consumer and provider to evaluate each other independently.
You are responsible for deciding whether to hire a particular attorney. You should independently review licensing, disciplinary history, experience, staffing, fees, costs, communication practices, conflicts, and representation terms.
9. No Guarantee of Review, Acceptance, or Recovery
Pursuing.com does not guarantee that any Participating Provider will receive, open, review, respond to, investigate, accept, or pursue a submission.
A lack of response does not mean that a matter lacks merit. A response or request for more information does not mean that a matter will be accepted.
We do not guarantee that you have a valid claim, that a claim can be filed, that evidence is sufficient, that a defendant can be located, that funds are available, or that any settlement, verdict, award, benefit, or other recovery will occur.
Legal results depend on facts, evidence, law, jurisdiction, parties, defenses, deadlines, insurance, collectability, professional judgment, and other circumstances outside Pursuing.com’s control.
10. Deadlines and Emergencies
Statutes of limitation, statutes of repose, notice requirements, administrative deadlines, filing deadlines, preservation duties, and other time limits may apply to a legal matter.
Pursuing.com does not calculate, monitor, preserve, or extend those deadlines. You remain solely responsible for protecting your rights and contacting a qualified attorney promptly.
Do not use the Platform to serve legal process, submit a government claim, appeal a decision, notify an insurer, preserve evidence, comply with a court order, or deliver any notice that must be received by a particular deadline.
11. Calls, Texts, Emails, and Other Communications
By providing contact information and submitting a request, you authorize Pursuing.com to contact you about the request using the contact methods you provide, subject to the disclosure and consent language shown when you submit the information.
When expressly disclosed and consented to, Pursuing.com and identified Participating Providers or partners may contact you by telephone, text message, email, prerecorded message, or automated technology. Message and data rates may apply. Message frequency may vary.
Consent to receive marketing communications is not a condition of purchasing goods or services or retaining an attorney. The specific consent presented at the point of submission controls over any inconsistent general description in these Terms.
You may revoke consent or request that communications stop through any reasonable method, including replying STOP to a supported text message, using an unsubscribe link in an email, communicating the request during a call, or contacting support@pursuing.com.
Revocation applies prospectively after it is received and processed. A communication already in transmission or initiated before processing may still be delivered. Certain nonmarketing or transactional communications may continue when legally permitted or required.
Pursuing.com may maintain records of consent and revocation, including the disclosure displayed, date and time, telephone number, email address, source page, IP address, user agent, submission identifier, and related technical records.
Communications are also subject to applicable federal and state calling-hour, do-not-call, identification, recordkeeping, consent, and opt-out requirements.
12. User Accounts and Security
Some Platform features require an account. You are responsible for maintaining the confidentiality of your credentials and for activity performed through your account.
You agree to provide accurate account information, use reasonable security practices, and promptly notify us if you suspect unauthorized access.
You may not share credentials in a way that circumvents account, subscription, permission, or security restrictions.
We may require verification, reset credentials, restrict access, or suspend an account when we reasonably believe the account is compromised, fraudulent, unlawful, inactive, or being used in violation of these Terms.
13. Attorney Directory and Profiles
Attorney and law-firm profiles may be created, claimed, submitted, licensed, imported, generated from public records, or compiled from third-party sources.
Pursuing.com does not guarantee that a profile is complete, current, accurate, claimed, verified, or authorized by the person identified. The presence of a profile does not imply endorsement, participation, availability, or a business relationship.
Users should independently confirm licensure, good standing, disciplinary history, office locations, practice areas, credentials, certifications, and current contact information with the appropriate licensing authority or the professional directly.
Attorneys and firms are responsible for the accuracy and legal compliance of information they submit or claim. Requests to correct, update, or dispute profile information may be sent to support@pursuing.com.
14. Settlements, Verdicts, Testimonials, and Results Content
The Platform may display reported settlements, verdicts, awards, testimonials, case studies, estimates, examples, or other results content for general educational or advertising purposes.
Results content may be supplied by third parties, drawn from public sources, summarized, aggregated, estimated, or clearly labeled as illustrative. Pursuing.com does not guarantee that every reported result has been independently verified.
A displayed amount may represent a gross amount before legal fees, expenses, liens, allocations, reductions, taxes, or distributions to individual claimants.
Past results do not guarantee, predict, or promise a similar outcome. A result does not imply that a particular Participating Provider achieved it unless that attribution is expressly stated and appropriately supported.
15. Attorneys, Law Firms, Publishers, and Professional Users
Professional users are responsible for complying with all laws, regulations, court rules, bar rules, licensing requirements, advertising requirements, privacy requirements, consent obligations, contractual duties, and professional standards applicable to their activities.
A professional user may not use Platform information for unauthorized solicitation, resale, redistribution, harassment, discrimination, surveillance, credential theft, or any purpose unrelated to the authorized service.
Professional users must protect submitted information, limit access to authorized personnel, honor valid communication preferences, and delete or return information when required by law or agreement.
Nothing on the Platform guarantees a particular number, quality, jurisdiction, value, exclusivity, conversion rate, or outcome of any lead, inquiry, claimant, case, referral, opportunity, or campaign.
Commercial terms between Pursuing.com and a professional user are governed by the applicable signed agreement, order, campaign terms, or account terms.
16. Publishers, Affiliates, and Traffic Sources
Publishers, affiliates, influencers, marketing partners, and traffic providers must accurately identify themselves when required and must comply with applicable advertising, endorsement, privacy, consent, telemarketing, intellectual-property, and consumer-protection laws.
They may not impersonate Pursuing.com, a law firm, an attorney, a government agency, a court, or a settlement administrator.
They may not make unauthorized promises about eligibility, case value, attorney acceptance, settlement amounts, timeframes, government benefits, or legal outcomes.
Fraudulent, duplicate, fabricated, incentivized, manipulated, misrepresented, unlawfully obtained, or nonconsensual submissions may be rejected, withheld, investigated, reversed, or reported.
Pursuing.com may review traffic sources, landing pages, advertisements, consent records, and related evidence for compliance with applicable agreements and law.
17. Consumer Cost and Professional Compensation
Pursuing.com generally does not charge consumers to submit an initial case inquiry unless a particular paid service clearly states otherwise.
Participating Providers and professional users may pay Pursuing.com for advertising, subscriptions, directory services, technology, intake, lead delivery, marketing, support, or other services.
Attorney fees and legal expenses are governed solely by the separate agreement between a consumer and the retained attorney or law firm. Consumers should carefully review contingency fees, hourly fees, expenses, liens, referral arrangements, and termination rights before signing a representation agreement.
Pursuing.com does not receive a portion of a consumer’s legal recovery unless a separate arrangement is lawful, properly disclosed, and permitted by all applicable professional and legal requirements.
18. Acceptable Use
You agree not to:
- Submit false, misleading, fraudulent, or fabricated information.
- Impersonate another person or organization.
- Submit information for another person without authority.
- Use the Platform for unlawful, threatening, abusive, discriminatory, or deceptive conduct.
- Interfere with the Platform, its security, or another user’s access.
- Probe, scan, test, bypass, or defeat security or access controls.
- Upload malware, harmful code, corrupted files, or destructive content.
- Scrape, harvest, crawl, index, copy, or extract Platform data without authorization.
- Use automated systems to create accounts or submit inquiries without permission.
- Reverse engineer, decompile, or attempt to obtain source code except where the law prohibits restricting that activity.
- Resell, redistribute, publish, or commercially exploit Platform information without authorization.
- Use Platform information to train an artificial intelligence model without written permission.
- Use the Platform to spam, harass, or unlawfully solicit consumers or professionals.
We may investigate suspected misuse and preserve or disclose relevant information when reasonably necessary to protect the Platform, enforce agreements, prevent harm, or comply with law.
19. Submitted Content and License
You retain ownership of content you submit, subject to the rights required to operate the Platform.
You grant Pursuing.com a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, format, translate, analyze, transmit, display, and use submitted content as reasonably necessary to:
- Operate, secure, maintain, and improve the Platform.
- Process and route inquiries.
- Communicate with users and Participating Providers.
- Prevent fraud, abuse, duplication, and security threats.
- Provide support and maintain records.
- Comply with legal, regulatory, contractual, and professional obligations.
This license applies to submitted text, photographs, videos, audio, documents, recordings, metadata, electronic signatures, and related materials. It ends when no longer reasonably necessary, subject to legal, security, backup, dispute, retention, and contractual obligations.
20. Platform Content and Intellectual Property
The Platform and its original software, design, branding, databases, selection, arrangement, text, graphics, interfaces, and functionality are owned by or licensed to Pursuing.com and are protected by applicable intellectual-property laws.
Subject to these Terms, Pursuing.com grants you a limited, revocable, nonexclusive, nontransferable license to use the Platform for lawful personal or authorized business purposes.
You may not reproduce, republish, modify, distribute, sell, license, create derivative works from, or commercially exploit protected Platform material without written permission.
Third-party names, trademarks, logos, case names, products, and materials remain the property of their respective owners. Reference to them does not necessarily imply endorsement, sponsorship, or affiliation.
21. Copyright and Rights Complaints
If you believe content available through the Platform infringes a copyright or other right, send a detailed notice to support@pursuing.com.
The notice should include:
- Your name and contact information.
- Identification of the protected work or right.
- Identification and location of the challenged material.
- A statement explaining why you believe the use is unauthorized.
- A statement that the information in the notice is accurate.
- Your physical or electronic signature.
We may remove, restrict, preserve, or restore material as appropriate under applicable law. Knowingly submitting a materially false claim may create legal liability.
22. Privacy and Data Processing
Our Privacy Policy describes how we collect, use, disclose, retain, and protect personal information and explains applicable privacy choices.
By using the Platform, you acknowledge that information may be processed by Pursuing.com, its service providers, Participating Providers, intake partners, hosting providers, communications providers, analytics providers, security providers, and other authorized recipients as described in the Privacy Policy and submission disclosures.
Review the Privacy Policy before submitting information.
23. Third-Party Services
The Platform may contain links to or integrations with third-party websites, services, software, payment systems, communication tools, maps, analytics systems, artificial intelligence providers, or other resources.
Third parties operate independently and may have separate terms, privacy policies, security practices, and service limitations. Pursuing.com does not control and is not responsible for third-party content, availability, security, practices, products, services, or transactions.
Your use of a third-party service is governed by your agreement with that third party.
24. Electronic Records and Signatures
By using the Platform, electronically accepting a disclosure, checking a consent box, entering your name, clicking a submission button, or taking another action identified as acceptance, you agree to conduct the applicable transaction electronically.
Electronic actions, records, acknowledgments, and signatures may have the same legal effect as paper records and handwritten signatures, subject to applicable law.
You are responsible for maintaining a device, internet connection, current browser, and software capable of accessing, displaying, and retaining electronic records.
You may save or print these Terms and other disclosures. To request an available copy or update your electronic contact information, contact support@pursuing.com.
A decision not to conduct a future transaction electronically does not affect the validity of records or consent previously provided.
25. Availability, Security, and Data Loss
We work to maintain the Platform but do not guarantee continuous, uninterrupted, timely, secure, or error-free access.
The Platform may be affected by maintenance, software defects, telecommunications failures, cloud-provider outages, cyberattacks, unauthorized access, malware, utility failures, natural disasters, government action, third-party failures, or other events.
No transmission or storage system can be guaranteed completely secure. You are responsible for keeping copies of information and materials important to you.
We may modify, suspend, limit, or discontinue Platform features when reasonably necessary for security, maintenance, legal compliance, business operations, or service improvement.
26. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE PLATFORM AND ALL CONTENT, TOOLS, CONNECTIONS, DIRECTORIES, SCORES, SUMMARIES, COMMUNICATIONS, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
PURSUING.COM DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND RESULTS.
Pursuing.com does not warrant that:
- The Platform will always be available, secure, current, complete, or error-free.
- A submission will be received, preserved, reviewed, or answered.
- A particular attorney, firm, or provider is available or appropriate.
- A directory profile or third-party statement is accurate or complete.
- An automated output, score, estimate, summary, or classification is accurate.
- A legal matter will be accepted or produce a recovery or other result.
- Communications will be delivered within a particular timeframe.
- The Platform will satisfy your legal, professional, or regulatory obligations.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, the exclusions apply only to the maximum extent permitted by law.
27. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PURSUING.COM AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, ENHANCED, OR PUNITIVE DAMAGES.
This includes damages arising from lost opportunities, lost profits, lost data, missed deadlines, loss of evidence, reliance on Platform information, inability to use the Platform, unauthorized access, communications, third-party conduct, attorney or law-firm conduct, or the outcome of a legal matter.
To the fullest extent permitted by law, Pursuing.com’s aggregate liability arising from or relating to a consumer’s use of free Platform services will not exceed $100.
For a professional user that paid Pursuing.com for a service, aggregate liability will not exceed the amount paid by that user to Pursuing.com for the service giving rise to the claim during the six months immediately preceding the event giving rise to liability, unless a signed agreement provides a different limitation.
These limitations do not exclude liability that cannot lawfully be excluded or limited.
28. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Pursuing.com and its affiliates, officers, employees, contractors, and service providers from third-party claims, losses, liabilities, damages, judgments, and reasonable expenses arising from:
- Your intentional misuse of the Platform.
- Your unlawful conduct.
- Your material violation of these Terms.
- Content you submit without authority.
- Your infringement or violation of another person’s rights.
- For professional users, your advertising, communications, intake, handling of leads, or professional services.
Pursuing.com may control the defense and settlement of a covered claim, provided that it will not agree to a settlement imposing an admission or nonmonetary obligation on you without your reasonable consent.
29. Events Beyond Reasonable Control
Pursuing.com is not responsible for delay, interruption, or failure caused by events beyond its reasonable control, including natural disasters, severe weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, utility failures, telecommunications failures, cloud-service outages, cyber incidents, government action, or third-party service failures.
30. Suspension and Termination
You may stop using the Platform at any time.
We may suspend, limit, or terminate access when reasonably necessary to protect users, investigate misuse, maintain security, comply with law, enforce agreements, respond to nonpayment, or protect Platform operations.
Termination does not eliminate obligations or rights that arose before termination. Provisions concerning ownership, submitted-content licenses, professional obligations, disclaimers, liability, indemnification, disputes, and records survive as appropriate.
31. Changes to the Platform or These Terms
We may update the Platform and these Terms to reflect service, operational, legal, security, or business changes.
Updated Terms will be posted with a revised effective date. When legally required or reasonably appropriate, we may provide additional notice by email, account message, banner, or other method.
Continued use after updated Terms become effective constitutes acceptance of the updated Terms. Material changes do not apply retroactively where prohibited by law.
32. Informal Dispute Resolution
Before filing a lawsuit concerning these Terms or the Platform, you and Pursuing.com agree to attempt in good faith to resolve the dispute informally, except when immediate injunctive relief is reasonably necessary.
A dispute notice must describe the claimant, relevant account or submission, facts, requested relief, and supporting information. Send notices to support@pursuing.com with the subject line “Legal Dispute Notice.”
The parties will have 30 days after receipt of a complete notice to attempt resolution before filing suit, unless a limitations period requires earlier filing.
33. Governing Law and Venue
These Terms and disputes arising from or relating to the Platform are governed by the laws of the State of Hawaii, without regard to conflict-of-law principles, except where federal law or another non-waivable law applies.
Subject to applicable jurisdictional requirements, any lawsuit arising from or relating to these Terms or the Platform must be brought exclusively in the state courts located in Honolulu County, Hawaii, or the United States District Court for the District of Hawaii.
You and Pursuing.com consent to personal jurisdiction and venue in those courts, except when applicable law gives a consumer a non-waivable right to bring a claim elsewhere.
TO THE FULLEST EXTENT PERMITTED BY LAW, EACH PARTY WAIVES THE RIGHT TO A TRIAL BY JURY FOR A DISPUTE ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM.
TO THE FULLEST EXTENT PERMITTED BY LAW, CLAIMS MUST BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION.
If a jury-trial waiver, class-action waiver, venue term, or other portion of this section is unenforceable for a particular claim, the remainder will continue to apply to the fullest extent permitted by law.
34. Notices
Pursuing.com may provide notices through the Platform, an account, email, text message, or other contact information associated with your submission or account.
You are responsible for keeping contact information current.
Legal notices to Pursuing.com must be sent to support@pursuing.com and must clearly identify the sender, matter, requested action, and relevant supporting information.
An email notice is considered received when successfully delivered to the designated address, subject to evidence that the message was rejected or undeliverable.
35. Order of Precedence
If applicable documents conflict, the following order generally controls:
- A signed agreement specifically governing the service or transaction.
- A service-specific electronic agreement, campaign term, consent, or disclosure.
- These Terms.
- General Platform descriptions or marketing materials.
The Privacy Policy separately governs personal-information practices. An attorney engagement agreement separately governs the relationship between a consumer and retained counsel.
36. Miscellaneous
These Terms, the Privacy Policy, and applicable service-specific agreements constitute the agreement concerning use of the Platform.
If a provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective.
Failure to enforce a provision is not a waiver. A waiver must be in writing and applies only to the specific circumstance identified.
You may not assign these Terms without our written permission. Pursuing.com may assign these Terms in connection with a merger, acquisition, reorganization, financing, sale of assets, change of control, or transfer of Platform operations.
Section headings are for convenience and do not limit interpretation. The words “including” and “include” mean “including without limitation.”
These Terms do not create a partnership, joint venture, agency, fiduciary, employment, franchise, or attorney-client relationship.
